1. Acceptance of Terms
By accessing or using DocChaser, you agree to be bound by these Terms of Service. If you do not agree, you may not use our services. These terms apply to all visitors, users, and others who access or use the service.
2. Description of Service
DocChaser provides a white-labeled automated document collection platform for mortgage brokers and professional service firms. Our service includes borrower portals, automated reminders, document management, and compliance tracking tools.
3. User Accounts and Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
4. Acceptable Use Policy
You agree not to use DocChaser for any unlawful purpose or in any way that could damage, disable, overburden, or impair our service. You may not attempt to gain unauthorized access to any portion of the service or systems. You are responsible for all content uploaded by you or your borrowers.
5. Payment Terms
Subscription fees are billed monthly in advance. A credit card is required for verification to start your trial. If DocChaser does not help you collect documents faster within your first few loans, you may request a full refund. Otherwise, all payments are non-refundable except where required by law. We reserve the right to change pricing upon 30 days notice. Failed payments may result in account suspension. Annual billing receives a 15% discount.
6. Data Processing and Security
We implement AES-256-GCM encryption for data at rest and TLS 1.3 for data in transit. You retain ownership of your data. We process borrower data solely to provide the service and comply with applicable laws including GLBA and CCPA.
7. Intellectual Property
DocChaser and its original content, features, and functionality are owned by TerraKode LLC, doing business as DocChaser, and are protected by international copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive license to use the service during your subscription.
8. Limitation of Liability
To the maximum extent permitted by law, DocChaser shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of the service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.
9. Termination
You may terminate your account at any time. We may suspend or terminate your account for violations of these terms. Upon termination, your data will be retained per our data retention policy (7 years for completed loans, 90 days for incomplete loans) then securely deleted.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action arising from these Terms shall be brought exclusively in the courts of Miami-Dade County, Florida.
11. Dispute Resolution
Before filing any claim, you agree to attempt to resolve disputes informally by contacting us at [email protected]. If informal resolution fails, disputes shall be resolved through binding arbitration under AAA rules in Florida.
12. Changes to Terms
We may modify these Terms at any time. We will provide at least 30 days notice of material changes via email or through the application. Your continued use after changes constitutes acceptance.

14. Communications Terms
Program description: Text messages are sent under the name DocUpload, the client-facing messaging name of DocChaser (a TerraKode LLC product). DocChaser (a TerraKode LLC product) provides transactional SMS and automated voice call notifications sent on behalf of the organization that invited you — document request notifications, upload reminders, status updates, and urgent security alerts. No marketing or promotional content is sent.
How you opt in to texts: After your organization enrolls your number, DocChaser sends you a one-time confirmation text. Reply YES to opt in. Text notifications are optional and not a condition of using the DocChaser portal — you will receive the same document requests and updates by email and in your portal if you do not opt in.
How you are enrolled in calls: The organization that invited you confirms, when adding your phone number, that you consented during their client intake process to receive automated calls.
How to opt out of texts: Reply STOP to any message at any time. You will receive a one-time confirmation, then no further messages. Reply START to resubscribe.
How to opt out of calls: Use the automated opt-out option offered during any call, or contact the support email listed on this page. Opt-outs take effect immediately.

Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Voice calls are placed only between 8:00 AM and 9:00 PM in your local time zone (urgent security alerts excepted).
Your data: Mobile opt-in data and consent will not be shared with third parties or affiliates for marketing or promotional purposes.
DocChaser complies with CTIA guidelines, the TCPA, and applicable carrier requirements.

15. Organization Obligations
If you are an organization using DocChaser to communicate with your clients, you agree to the following:
- Orgs must collect client consent to SMS + voice notifications before enrolling a phone number, using language substantially similar to the Client Consent Guide.
- Orgs must retain evidence of that consent and provide it to DocChaser on request.
- Orgs may not enroll numbers for marketing purposes. DocChaser may suspend messaging for orgs that enroll clients without valid consent.
